The accused, K.D. was charged with trafficking property obtained by crime. A reported fraudulently registered car was flagged by the police. The police investigated the accused in a parking lot as they learned they were trying to sell the vehicle. The accused was placed under arrest and released from custody by way of an undertaking. Jonathan Pyzer represented K.D. and was successfully able to have all charges withdrawn with no admission of guilt. He was also
successful in not obtaining a criminal record for the accused. The crown attorney’s office’s initial position was for the accused to plead guilty, receive a sentence, and agree to submit a sample of his DNA subject to S.307 of the CC, however, we were successful in reaching a resolution with the crown resulting in all charges against the accused being discharged.
