Break and Enter, Mischief, and Assault

R. v. A.W.

Client was charged with two counts of break and enter, mischief under $5,000, and assault. He allegedly broke into his ex-girlfriend’s home by forcing open the door, then dragged her from her bedroom and pushed her onto a couch. A criminal record would have ended his pursuit of a law career. We used the complainant’s reluctance to convince the Crown the case was weak.

Outcome: All charges withdrawn after signing a peace bond, no criminal record, law career preserved.

R. v. B.A.

Client was charged with assault with a weapon, two counts of domestic assault, and mischief under $5,000. His wife alleged he threatened her with a coffee cup, pulled her hair, punched her, and smashed her phone during an argument. He had no prior police history. We secured his approval for diversion through the Partner Assault Response program.

Outcome: All charges withdrawn after completing PARS program and signing a peace bond, no criminal record.

R. v. D.M.

Client was charged with domestic assault and mischief under $5,000. His girlfriend of eight years, who was pregnant at the time, alleged he pushed her head into a wall and destroyed her phone during an argument. We successfully defended him at trial.

Outcome: Not guilty on all charges, client found innocent at trial.

Client was charged with mischief under $5,000 after allegedly smashing a car windshield following an evening of drinking. Police apprehended him metres from the scene. We successfully had the charge withdrawn.

R. v. D.R.

Client was charged with mischief under $5,000, two counts of assault with a weapon, and assault. He was arrested, provided a statement, and released on an undertaking with conditions. We successfully had all charges withdrawn in exchange for a 12-month peace bond.

Outcome: All charges withdrawn, no criminal record, peace bond for 12 months.

Uttering Threats, Assault with a Weapon, and Dangerous Driving

R. v. O.S.

Client was charged with uttering threats, assault with a weapon, and dangerous operation of a motor vehicle. He allegedly followed his wife to work and drove his car toward her, forcing her to jump out of the way, while threatening to kill her. After being denied bail in the Ontario Court of Justice, we successfully obtained his release at a bail review in Superior Court.

Outcome: Bail granted on review in Superior Court, client released from custody pending trial.
