Section 10 of the Charter of Rights and...

  Included in the section 10(b) of the Charter of Rights and Freedoms is your right to counsel upon arrest or detention. Section 10 of the Canadian Charter of Rights and Freedoms contains three rights that every individual has upon arrest or detention.  Section 10 states that “everyone has the right on arrest or detention”: a. To be informed promptly of the reasons therefore; b. To retain and instruct counsel without delay and to be informed of that right; and c. To have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful. These rights attach to any individual who is arrested or detained by the police or any other government agency.
