Assault & Violent Crime Recent Case Summaries
Acquittal
R. v. R.S.
Two clients were jointly charged with six counts of threatening death. The Crown alleged the clients contacted the complainants by phone and threatened to kidnap and kill them as part of an ongoing dispute between families. We represented both clients at trial and successfully defended against all charges.
Charges Withdrawn
R. v. A.C.
Client, who had twenty-four previous convictions, was charged with forcible entry, mischief, and two counts of breaching probation. The Crown alleged the client and a co-accused forced their way into an apartment by smashing through windows and assaulted an occupant with a weapon causing bodily harm. On the morning of trial, we successfully secured the withdrawal of all charges.
Charges Withdrawn
R. v. K.A.
Client was charged with uttering threats and criminal harassment following a dispute with his landlord over an unfixed leaky roof. The client admitted to police that he lost his temper and threatened to “knock out” the landlord. The evidence against the client was strong, including an audio recording of the threats, a witness, and the client’s own admissions. The client was applying for Canadian citizenship, and a conviction on either indictable offence would have jeopardized his application. We successfully advocated for the withdrawal of both charges, with the matter resolved by a section 810 peace bond.
Charges Withdrawn
R. v. D.B.
Client was charged with criminal harassment. The Crown alleged the client harassed her former boyfriend by calling his home over one hundred times and attending at his family’s home to threaten them. The client maintained her innocence throughout. We persuaded the Crown to resolve the matter by way of a section 810 peace bond rather than criminal prosecution, resulting in the withdrawal of the charge before a trial date was set.
Not Guilty Verdict
R. v. C.C.
Client, who had over thirty previous convictions, was charged with two counts of criminal harassment. The Crown alleged the client made numerous threatening and lewd phone calls to a neighbour over several years. We defended the client at a contested trial and secured a not guilty verdict on all charges.
Charges Withdrawn
R. v. A.W.
Client was charged with two counts of break and enter, mischief under $5,000, and assault. The complainant, the client’s former partner of four years, alleged the client repeatedly called and texted her, attended her residence throwing rocks at her window, broke in by forcing the door open, and dragged her from her bedroom to the living room. It was essential the client avoid a criminal record as he was pursuing a career in law. We used the complainant’s reluctance to proceed to demonstrate the weakness of the Crown’s case, resulting in all charges being withdrawn upon signing a section 810 peace bond.
