Drug Offenses Recent Case Summaries

Client was charged with possession of crack cocaine and obstructing police. During an undercover investigation, police entered a suspected crack house following a drug transaction. Officers alleged the client blocked their entrance by body checking them as they chased a suspected dealer upstairs. Upon arrest, the client was found with a quantity of crack cocaine. We successfully negotiated the withdrawal of all charges before a trial date was set.

Client was charged with possession of hashish. Police responded to a motor vehicle accident and found the vehicle overturned and demolished. Officers investigated both occupants and found a small package containing 3.5 grams of hashish. Both individuals allegedly confessed that the hashish belonged to them. Police observed the client in Toronto’s Kensington Market conducting a hand-to-hand drug transaction with another individual. Client was charged with possession of marijuana. We represented the client and successfully persuaded the Federal Prosecution Service of Canada to request a stay of the charge without any conditions.

Client was charged with possession of a controlled substance and possession of stolen property. Police observed three of the client’s friends in a stolen vehicle. When spotted, the occupants fled and police gave chase. Officers alleged they saw the client pull a bag of marijuana from his pocket and drop it while running. On the morning of trial, we demonstrated there was no reasonable prospect of conviction and the Crown withdrew all charges.

Client was charged with possession of marijuana and breach of an undertaking. Police observed the client with two friends, then detained, investigated, and searched him, allegedly finding 3.7 grams of marijuana. We prepared a Charter application arguing the client was arbitrarily detained and illegally searched. Before the trial began, the Crown agreed to withdraw all charges.
