Charges Withdrawn

Forcible Confinement, Theft, Assault

R. v. J.S.

Client, a young offender, was charged with forcible confinement, theft under $5,000, and assault. The Crown alleged the client got into an altercation with a worker at the group home where he resided, assaulted and forcibly confined the worker, and stole property belonging to the group home. We successfully negotiated the withdrawal of all charges.

Outcome: All charges withdrawn, no criminal record, youth avoided conviction.

Charges Withdrawn

Possession for the Purpose of Trafficking

R. v. L.

Client, a young person, was found with approximately two ounces of marijuana which he admitted was for sale. He was charged with possession for the purpose of trafficking. We negotiated a resolution where the charge was withdrawn after the client completed drug counselling.

Outcome: Charge withdrawn, no criminal record, youth avoided conviction.

Charges Reduced

Aggravated Assault and Assault with a Weapon

R. v. H.H.

Young offender was charged with aggravated assault and assault with a weapon. He allegedly slashed a classmate’s forearm with a knife during a card game dispute at school, requiring stitches and an ambulance. The Crown sought jail time. We had the aggravated assault charge withdrawn in exchange for a guilty plea to the lesser offence of assault with a weapon and secured probation instead of imprisonment.

Outcome: Aggravated assault withdrawn, pleaded to lesser charge, probation instead of jail.

Charges Stayed

Theft, Fail to Stop for Police, Dangerous Driving, and Driving Without a Licence

R. v. R.E.

Young offender was charged with theft, failing to stop for police, dangerous driving, and driving without a licence. The 15-year-old allegedly stole gas and fled from police, with an officer suffering serious injuries during the arrest. We filed a successful Charter application arguing his right to trial within a reasonable time was breached.

Outcome: All charges stayed due to Charter breach, no criminal record.

Bail Granted

Robbery with a Firearm and Bail Violations

R. v. K.C.R.

Young offender was charged with two armed robberies of a gas station and convenience store while masked, plus multiple bail breaches. He was already on two previous robbery-related bails with house arrest conditions. Despite strong Crown opposition, we secured another bail allowing him to remain with his mother.

Outcome: Bail granted despite serious charges and prior bail breaches, client released to mother's supervision.

Charges Withdrawn

Assault Causing Bodily Harm

R. v. Q.A.

Young offender was charged with assault causing bodily harm after a school fight. The other student was pushed down stairs and needed stitches. We secured an extrajudicial measures program that included an apology letter and mediation.
