The accused, S.A. was charged with counts of Indecent Act, exposing genitals to a person under 16, and mischief obstructing property. The accused was caught masturbating in public by the beach while looking at a child in a swimming suit. They were identified by the police, and then he ended up turning himself in, and was released on a promise to appear with conditions. The accused was tried in a contested trial where the counsel was able to grant him an acquittal. Counsel was able to raise a reasonable doubt in both the identity of the perpetrator and if the alleged act occurred at all through skillful cross examination in trial. This result was excellent as the accused ended up with no criminal record and avoided a potential sex offender registry.
