Role of a Criminal Defence Lawyer in Property Offence Cases

Past Successes in Property Offence Cases

Our experience has helped clients avoid criminal records and achieve favourable outcomes in even the most challenging cases. Below are some examples of our recent successes:

Charges Withdrawn

Possession of Stolen Property, Possession for the Purpose of Trafficking, Breach of Release Order

R. v. A. A.

Client faced serious provincial and federal charges including possession of stolen property over $5,000, possession of a controlled substance for the purpose of trafficking, and breach of a release order. A two-day trial was scheduled, but we resolved the provincial charges through extrajudicial sanctions on the day of trial. We also negotiated the complete withdrawal of all federal charges during pretrial discussions with the Crown.

Outcome: All federal charges withdrawn, provincial charges diverted, no criminal record.

Charges Withdrawn

Possession of Stolen Property

R. v. T.Y.

Client, a young offender, faced four counts of possession of property obtained by crime after police observed him loading stolen motor vehicle engines into a vehicle during an undercover investigation. We negotiated with the Crown and secured a withdrawal of all charges before trial.

Outcome: No youth record, no trial, all charges withdrawn completely.

Bail Granted

Assault with a Weapon, Break and Enter, and Weapons Offences

R. v. J.M.

Client faced over ten charges including assault with a weapon, break and enter, uttering threats, and possession of incendiary material. He allegedly entered a home while masked and armed with a samurai sword, hatchet, and gasoline, then attacked a resident and poured gasoline throughout the house. Despite strong Crown opposition and a lengthy criminal record with prior weapons and violent offences, we secured his release.

Outcome: Bail granted despite serious charges and extensive criminal history, client released pending trial.

Charges Withdrawn

Robbery with a Firearm, Break and Enter, and Weapons Offences

R. v. M.D.

Client was charged with robbery with a firearm, break and enter with intent, use of an imitation firearm, possession of a dangerous weapon, disguise with intent, and pointing a firearm. She and two co-accused allegedly broke into a home and robbed two women while disguised and armed with firearms and an axe. We convinced the Crown not to proceed with the prosecution.

Outcome: All charges withdrawn, no criminal record.

Charges Withdrawn

Trafficking Property Obtained by Crime

R. v. K.D.

Client was charged with trafficking property obtained by crime after police flagged a fraudulently registered vehicle the client was attempting to sell. The Crown’s initial position required a guilty plea, a sentence, and a DNA sample. We negotiated with the Crown and secured a withdrawal of all charges with no admission of guilt.

Outcome: No criminal record, no guilty plea, no DNA order, all charges withdrawn completely.

Peace Bond

Break and Enter with Intent and Assault

R. v. A. M.

Client was charged with break and enter with intent and assault. Surveillance footage and photos were admitted as evidence against him. Through pretrial negotiations, we secured a common law peace bond resolution.

Outcome: All charges resolved with a peace bond, no criminal conviction.
